If that is not a public domain picture with rights to alter and he took and altered it for political purposes for monetary gain, that just seems like is should be crazy criminal and crazy civil punitive.

Love Island? Apparently the photo was not from a Trump ad though. It was from a site called Conservative News Daily (I won't link) shilling for Trump. They don't so much as have a wiki, and I'm not deep diving to figure them out.
It looks like it's still up and being used in an ad of sorts. They are providing the hat for free, "just pay shipping."
I don't think that gets them around using the images for commercial purposes. If you look at the link, it's full of other likely photoshopped images grabbed from social media. Likely a fly by night website services job maybe an internal one. It's worth a look actually to see all the stolen images.
