OK, I went and read the "article" and looks like it is just saying they aren't eligible because Trump hasn't nominated them. *shrug*
Both men are serving on an acting basis, and neither has been nominated by Mr. Trump for permanent roles, which would require Senate confirmation. As a result, neither man is eligible to be elevated to the Department’s top job.

During a June 2017 Cabinet meeting, Trump went around the table, allowing his top aides to thank him for allowing them to serve his administration. Then-White House Chief of Staff Reince Priebus called the opportunity a “blessing.”

A trove of documents released Tuesday by the House Education and Labor Committee shows the Education Department provided $10.7 million in federal loans and grants to students at the Illinois Institute of Art and the Art Institute of Colorado even though officials knew the for-profit colleges were not accredited and ineligible to receive such aid.

The documents build on prior reports from the committee describing efforts by Education Department officials to shield Dream Center Education Holdings, owner of the Art Institutes and Argosy University, from the consequences of lying to students about the accreditation of its since-closed schools. Now it appears the Education Department tried to shield itself from an ill-fated decision to allow millions of dollars to flow to those schools.

Rep. Robert C. “Bobby” Scott (D-Va.), chairman of the House Education Committee, is threatening to subpoena Education Secretary Betsy DeVos for more documents related to the department’s role in Dream Center’s actions. Scott says the agency has obstructed the committee’s investigation and refused to answer questions, as emails and letters paint a picture of a federal agency complicit in an effort to place profits before students.

Letters from senior Education Department official Michael Frola to the presidents of the two Art Institute campuses were among the documents made public Tuesday by House Democrats. Frola acknowledges in the May 2018 letters that the schools’ accreditation status made them ineligible to receive federal loans and grants through their students.

The for-profit schools’ downgraded designation as “preaccredited” institutions prohibited the receipt of federal student aid, although nonprofit schools with the same status can receive aid. To rectify the problem, Frola said, the department would retroactively — and temporarily — designate the Art Institutes as nonprofits effective Jan. 20, 2018, the date they lost their accreditation.

At the time, Dream Center was seeking approval from the Education Department, the accrediting commission and the Internal Revenue Service to turn the chain of for-profit colleges it purchased in 2016 into nonprofit schools. That designation would shield the company from having to report whether graduates were earning enough to repay their student loans.

In 2017, a subsidiary of the Dream Center, in partnership with a private equity fund, purchased the Art Institutes, South University, and Argosy University systems of for-profit colleges from Education Management Corporation. The transaction received significant scrutiny, due to concerns about Dream Center's ability to successfully manage the acquired schools, and criticism that the transaction was designed to allow the schools to avoid increased regulation of for-profit colleges. The transaction, which was not approved by the Department of Education under the Obama Administration, was approved in 2017 by Secretary of Education Betsy DeVos. In 2019, a number of the art institutes and other colleges were closed, with some closures announced abruptly in the middle of the academic year. Some of the Art Institute programs were transferred to Studio Enterprise, a Los Angeles creative arts training firm funded by principals of the private equity firm Colbeck Capital Management.

The Trump administration’s education department has been fined $100,000 for violating a court order to stop demanding money from student fraud victims.

Betsy DeVos, the education secretary, was held in contempt of court by a federal judge after her department continued to collect loan repayments from former students of a now-defunct college chain.

This week, the judge said Ms DeVos and the education department had made “only minimal efforts” to comply with the 2018 court order. She ruled that the administration must now file monthly reports to prove it is complying with the order.

The judge wrote there was “no question” the department violated the court order and had “not provided evidence that they were unable to comply with the preliminary injunction".

The education department said it was “disappointed in the court’s ruling” but accepted loan servicers had “made unacceptable mistakes".

The department has previously acknowledged it had incorrectly sent loan bills to more than 16,000 former Corinthian students, prompting more than 3,000 to send payments, and seized wages or tax refunds from 1,800 borrowers.

It also provided credit agencies with negative reports for about 800 borrowers.

Ms Kim has threatened to impose further sanctions on the department if it fails to follow the order.

The $100,000 fine will help repay students for expenses they incurred while raising the issue to the court.

That's what I don't get. Had DeVos ever showed any concern about spending tax payer money to get her way? (This says nothing of the millions her family spends for political power and favor, where $100,000 isn't even in the realm of punitive. It's an indulgence.)

"'Some people did something,' we've heard it said."

The education secretary shared the anecdote while accepting an award at the Independent Women's Forum (IWF), a conservative non-profit organization, annual gala on Wednesday night. She used her speech to highlight problems she saw in the education system, including a lack of proficiency in reading, math and U.S. history, and the solution, which she claimed is her Education Freedom Scholarships proposal.

Trump and Bill Barr corrupts the DOJ entirely. Remember this. The Democratic candidate will be under investigation. It is almost certain now. This country is in *severe danger*.

Attorney General William P. Barr has told associates he disagrees with the Justice Department’s inspector general on one of the key findings in an upcoming report — that the FBI had enough information in July 2016 to justify launching an investigation into members of the Trump campaign, according to people familiar with the matter.

The Justice Department’s inspector general, Michael Horo­witz, is due to release his long-awaited findings in a week, but behind the scenes at the Justice Department, disagreement has surfaced about one of Horowitz’s central conclusions on the origins of the Russia investigation. The discord could be the prelude to a major fissure within federal law enforcement on the controversial question of investigating a presidential campaign.

Barr has not been swayed by Horowitz’s rationale for concluding that the FBI had sufficient basis to open an investigation on July 31, 2016, these people said.
Edit: Shit got weirder - the DOJ Spokesperson dropped this statement off after the WaPo article. Some are reading it as a break within DOJ. Others are pointing out that the DOJ did something similar with Barr's very misleading summary of the Mueller report.
