It's not OK in a broad sense but in terms of liability for that individual, if he was trained to do so and observed supervisors doing it, it certainly lightens his load. The Union's job is to defend the union member, even if it's to the detriment of the department.


Still, it seems like it would take a certain type of person to torture restrained prisoners...

The Forest Hill police officer who failed to find a kidnapped 8-year-old Fort Worth girl during a search of a hotel room has been fired, officials said.

The Forest Hill Police Department has faced criticism after Sgt. Richardson Wolfe did not find the missing girl during the search of a hotel room, where she was found with her alleged abductor about two hours later.

The chief said Wolfe's firing is not the result of his not finding the kidnapped girl. It's in reaction to how Wolfe handled the second attempt to find the girl.

Dennis said the sergeant displayed "shocking ineptitude" and was "woefully incompetent" during a second call to the hotel that night.

Wolfe responded twice the night an 8-year-old was kidnapped in Fort Worth. He searched a hotel room two hours prior to Fort Worth police finding the child in that same room.

Wolfe was there when Fort Worth police rescued the girl.
It's almost as if people are the problem.

No wonder Philly needed prosecutorial reform with a focus on cop behavior:
The Philadelphia Police Department announced Wednesday it had taken 72 officers off the streets in response to the discovery of thousands of offensive social media posts by the officers, including violent messages and racist memes. The officers were placed on desk duty as the social media scandal brews, implicating more than 300 officers of the city’s 6,500-officer police force. “We’ve talked about from the outset how disturbing, how disappointing and upsetting these posts are,” Philadelphia Police Commissioner Richard Ross said Wednesday. “They will undeniably impact police-community relations.”

The posts came to light as part of the work of the Plain View Project, a group of lawyers that began monitoring the social media accounts of Philadelphia officers in the fall of 2017 in order to assess whether the officers’ online behavior eroded public trust in the police force.
Other cities and especially Sheriffs' departments need to follow suit...

London Wallace had no gang connections and no criminal history.

"He's a high school kid. He likes playing basketball. He's a nice, calm, timid person," Kane said. "And you can kind of see that in the video. He's not used to police contact."

Officer Christopher Martinez wrote in his report that he thought Wallace was going to try to run away. He said he punched Wallace three times in the face, which let the officer get his back off the second story balcony railing.

Legal analyst Ralph Torres says police usually have a built-in civil lawsuit defense of fearing for the officer's safety.

"But in this case, the kid was patted down. There was nothing there," Torres said. "And I don't see anything that was consistent with an officer basically putting his fist right through his face."
Nolan Kane says it's important for the public to see the body camera footage so they can get the full picture, which often benefits police, but not in this case.

"In this case, it's not going to be London's word against the officer's word. The jury's going to get to see the full footage and they'll be able to decide whether this is something that's acceptable," Kane said.

They must have whiffed really badly screening this cop:
A Cleveland police officer was indicted on Wednesday on charges of attempted kidnapping and multiple counts of sexual offenses involving a 12-year-old girl, whom he urinated on at a school bus stop after she refused to get in his car, prosecutors said.
Oh, and he recorded it on his cellphone...

That off-duty police shooting at Costco...sounds a whole lot like manslaughter.
Paola French described what happened next as her son pushing or shoving the officer, while other witnesses described it as a punch or a strike, Galipo said.

The momentum of the strike caused Sanchez to move forward, and some witnesses have said that he loss balance and "temporarily went to the ground," Galipo said. Sanchez then allegedly handed his son to his wife, pulled out his gun and announced that he was a police officer, Galipo said.

At that point, Kenneth French was "moving away" from Sanchez, Galipo said. When his parents saw Sanchez pull out the gun and identify himself as a police officer, Russell French yelled out, "Don't shoot. My son is sick," Galipo said.

"I begged and told him not to shoot," Russell French said. "I said we have no guns and my son is sick. He still shot."

Paola French yelled out, "Please don't shoot. Please don't shoot," Galipo said.

Sanchez then allegedly fired at least eight rounds, striking all three family members, Galipo said. A man inside Costco stood and prayed over Russell French as he lied on the ground bleeding, he said.
So get pushed or struck *admittedly hard* by someone...respond by lighting up the whole family. Sounds reasonable. Anyway, If this was anyone but a cop they would almost certainly be indicted.

Judge Dredd's American Police State:
In one courtroom, Judge Richard Sinnott refused to drop charges against seven protesters -- even though prosecutors had requested the dismissals. He then had the protesters' defense lawyer arrested for trying to recite the law in court. In another courtroom, Judge Thomas Horgan told three protesters to "stay out of Boston." Because we live in a fucking police state.

For her part, Suffolk County District Attorney Rachael Rollins has vigorously opposed Judge Sinnot's bullshit, calling his conduct "unprecedented and outrageous" and filing an emergency petition with the Supreme Judicial Court to get the cases dismissed...

...There are so many disgraceful abuses of power going on that it's hard to even know where to start.

Oh, I know! Let's start with arresting lawyers for doing their jobs.

As described by Mass Live,

Susan Church, a criminal defense and immigration attorney, was representing a counter-protester in court on Wednesday when she had a disagreement with Judge Richard Sinnott. She was trying to read caselaw about a motion that prosecutors filed to drop charges against her client, Roderick Webber. Sinnott ordered her to be taken into custody.
Church was held for several hours before being released. Speaking after her release, Church said she had been "unlawfully, unreasonably and, honestly, outrageously arrested for simply doing my job."

No charges
A grand jury has declined to bring criminal charges in the case of an intellectually disabled man who was shot and killed by an off-duty Los Angeles police officer following a physical confrontation between the two in a Corona Costco back in June, according to the Riverside County District Attorney.

“There was approximately 3.8 seconds between when Mr. Sanchez was struck and the first round was fired,” said Joe DelGiudice, chief of the Bureau of Investigation for the DA’s office.

Sanchez fired 10 total rounds, four of which struck French. He was hit three times in the back and once in the shoulder, Johnstone told reporters. One round each struck French’s parents.

“The officer after being struck, thought he had been shot and believed there was an active shooter in front of him,” Hestrin said.

Sanchez, who has been with LAPD since 2012, has since been on paid administrative leave while the Riverside County D.A.’s Office investigates.

Hestrin said that just because Sanchez won’t face state criminal charges, he could still face department discipline or civil action.

Get me a fainting couch. According to KTLA the man was 20 feet away and running away. He was shot 3 times in the back and once in the shoulder. Also still - whole family got lit up. "Unfortunately" the camera closest to the incident failed and the only footage available was from a very far distance and not usable.

The statistics in this article are pretty damning in my opinion: (sorry the image is so big but /timg doesn't apparently work here).

Los Angeles is 10% black, 40% Latinx, 40% white.

News reports this morning were that he had been shot at multiple times over the past year. I just saw it in passing, so not sure if he had a history of nefarious dealings that made his death more likely or not.

The slightly better hit rate tells me that they are slightly more discerning when searching whites. Other than that, they're all roughly in the same hit rate of 16%-20%.

I'm wary of conspiracy theories, but this is super fishy.

It's come out that Brown was also shot in the mouth (the traditional punishment for squealing), and the police story is that the killers had come to Dallas from Louisiana to buy marijuana from him.

The killers drove to Dallas from Louisiana for WEED?? Are there no bars, restaurant kitchens, or high schools in Louisiana?

I think the point is that even if what you say is true, there is no evidence to support searching non whites vs whites at the rate they are doing so.

I think the point is that even if what you say is true, there is no evidence to support searching non whites vs whites at the rate they are doing so.
Are they working on a quota system where they are told to search blacks? And what is the solution? Stop searching when they hit a certain percentage?


It's not as simple as mere %s. Certain communities are higher crime because they are often higher poverty. This is not fair. It's is the result of historical, institutionalized economic racism. It needs to be addressed. But the police stop and search numbers are a result of this. They are not the cause.

The decision to search results in contraband in a 4% margin across all races indicates that whatever causes police to search is roughly equally effective across all races.

Now I'm willing to bet, and agree, that the decision to stop is also stacked against minorities and that is another topic but I'd also bet it's targeted by community/neighborhood.

Given the rates then why aren't white people searched more often? Right? I mean if white people have contraband as often as the other minorities then they should be searched more often right? But they aren't.

Maybe, maybe not. Presumably they're aren't searching at random. You could look at it as cops being right 20% of the time with whites and 17% with blacks. Again, IMO an insignificant difference but still right more with whites. Which would mean not reason to search more strictly based on the numbers.

Hell, they could search whites when they don't think there's contraband just to drive down the numbers. Weird/bad things happen when cops get quotas.

Sad you think it's a 'quota' when the differences are so large. What advocates including me want is fair treatment from the cops we pay for. And those numbers don't show fair treatment.

I don't think it's a quota. I'm asking if the perception is that it's a quota. And I'm saying that the solution isn't a quota.


What does fair treatment look like? Perfectly equal statistics?

“At its simplest level, it appears that blacks and Latinos are being subjected to a lower threshold of suspicion in order to be searched,” said Jack Glaser, a professor of public policy at UC Berkeley who has studied traffic stop data.

Glaser said the 24% search rate for African Americans raises questions about whether LAPD officers are targeting them because of their race.

“If you are searching a quarter of the people you’re stopping, you’re looking to search people,” he said. “You’re not just pulling people over for running stop signs and then happening to see they have a gun-shaped bulge in their pocket.”

Lorie Fridell, a criminology professor at the University of South Florida who authored a pioneering study on stop data, said the lower contraband rates for whites are a “warning signal” and should be reviewed by LAPD officials.

“Even though we can never prove or disprove bias, they are a strong red flag for unjustifiable disparity that requires an agency to at least take a closer look at the search practices,” said Fridell, who has conducted federally funded training on bias at police departments across the country.

I think it's time to disarm cops nationwide. No sidearms, just tazers and a shotgun in the trunk.

There are 4 extremely simple rules of firearm safety that even cops should follow. One of them is to always know/identify your target and what is behind it. All other details of this Ft. Worth incident aside, the officer did not follow at least one, and possibly 3, of the 4 cardinal rules and IMO that makes this a bad shoot. Whether it's murder or negligent homicide, that's where the details come in.

The Fort Worth Police Department officer who fired into a home, killing Atatiana Jefferson, has been charged with murder.

Aaron Dean, 34, was booked into jail Monday afternoon. Online court records show the now-fired officer was booked into the Tarrant County jail and charged with murder. A bond has not been set.

Chief Kraus added that he was going to meet with Dean Monday morning to fire him for violating the use of force policy, de-escalation policy, and for unprofessional conduct, but he resigned before that.

The resign before you are fired trick is a LEO staple to allow you to go to some other LEO job with near impunity....unless you end up being chrged with a crime of course and even then it has not stopped some from getting a new LEO job

A murder warrant for Aaron Dean, the Fort Worth officer who killed Atatiana Jefferson in her home, recounts what led up to the shooting from the perspective of her 8-year-old nephew.

The boy, who was in the room with Jefferson when she was shot, told a forensic interviewer that he and his aunt were playing video games together about 2:30 a.m. Saturday when she heard noises outside their home in the 1200 block of East Allen Avenue.

Jefferson, 28, took her handgun from her purse and pointed it “toward the window” before she was shot, the nephew said, according to the arrest-warrant affidavit.

The infuriating thing is that the identities of these officers are being withheld. They wouldn't provide information to the citizens to make a complaint and the ACLU has to sue to even get their identities. They are currently "John Doe" defendants in the lawsuit.
Though it was hot inside the bus, the temperature outside was in the teens as the hour approached 8 p.m. Butler, wearing his EIU team jacket, was heading back onto the bus when his coach suggested he take a selfie in front of Illinois' "BUCKLE UP, IT'S THE LAW" sign. The team had been taking pictures throughout the trip and posting them to social media to update parents and others on their location.

"As I took the picture, there was a line of police officers ... they came to a screeching stop in front of me," Butler said. "At that moment, I only knew a couple things to do that my dad always told me."


As a young black man, he had been taught by his dad to never give police a reason to think he would cause trouble. He remembered the lessons, and he dropped his phone, raised his hands, and got on the ground.

He could not imagine what the police wanted with him. But they weren't messing around.

His life was threatened
Bus driver Todd Slingerland knew immediately that something was going wrong.

"I was sitting in the driver's seat, waiting for the parents to get there, and Jaylan was the last one to get back on the bus," Slingerland said. "A car screamed in, and I jumped out of the bus, knowing something was going down that shouldn't be going down.

"As I got out, a second police car came screaming in."

Two officers had Jaylan on the ground — his face pressed into the snow and an officer's knee pressed into his back. One cop was pointing a shotgun, Butler and Slingerland said, and another had a gun pointed at the 19-year-old's head.

"He said, 'If you move, I'll blow your (expletive) head off,'" Butler said.

Slingerland heard the same threat and shouted at the police that Jaylan was his passenger, and they were making a mistake. As he rushed back to the door of the bus and yelled for the coach, two more police vehicles arrived.

Butler said he knew what was happening was wrong. In fact, at one point, he asked for the badge number of the officer who threatened to kill him. He was ignored, he said.

"Mr. Butler informed at least two defendants (officers) that he wanted to make a complaint," the ACLU lawsuit alleges. "The first defendant ignored him. The second defendant said, 'There's nothing I can do.'

"Neither defendant gave Mr. Butler any of the defendants' names, badge numbers, law enforcement agency affiliations, or any other information to enable him to file a complaint."

Poorly trained deputies.

They made a mistake but the worse offense was not owning up to it right there. Instead they tried to save face and also hide their identities.

If they just let him go as soon as they called in that it was the wrong guy there wouldn't be a story. Or it would be a minor one.

I know I'm always afraid I'll get that phone call, the one where the police has mistreated my black son over some stupid bullshit. Those police should be fired and never allowed to legally own a gun again in their lifetimes.

I read that whole thing and I'm still just as confused as ever. Am I right in that no one knows what happened and the police still aren't releasing the identities of the police from several cars responding to the incident and they consider the arrest justified because he resisted arrest even as there is no evidence he resisted arrest?

My comprehension is terrible. That can't be right, can it?
