The Supreme Court agreed on Friday to take up an abortion case this term, adding an explosive issue to an already robust docket of controversial issues in the middle of the 2020 presidential election.

The justices will consider a Louisiana law that requires doctors to obtain admitting privileges from a nearby hospital.

The Center for Reproductive Rights, representing an abortion clinic and two Louisiana physicians, argues that if the law is allowed to go into effect is will leave "only one doctor to care for every woman seeking an abortion in the state."

Louisiana argues that the law is necessary to provide a higher level of physician competence. The law, which has been on hold pending appeal, says doctors must have admitting privileges at a hospital within 30 miles of the facility where the abortion is performed. It is nearly identical to a Texas law that the Supreme Court struck in 2016. Back then, Justice Anthony Kennedy joined with the liberal justices to rule against the law. Chief Justice John Roberts, Justices Clarence Thomas and Samuel Alito were in dissent.

Unionist parties, who oppose the upcoming liberalisation, triggered the assembly's recall with a petition.

That became impossible when the nationalist SDLP left the chamber.

As a result no nationalist representatives remained, meaning no new speaker could be elected and the sitting was suspended after less than an hour.

South Carolina Senate subcommittee on Tuesday stripped protections for women who become pregnant from rape or incest from a bill that would outlaw abortions in the state after about six weeks of pregnancy.

The State newspaper reports the Senate Medical Affairs subcommittee then approved the bill by a 4-3 vote. The vote was along party lines, with Republicans favoring the move and Democrats opposing it, reports CBS Columbia affiliate WLTX-TV.

The bill would still allow for abortions if it was to save the life of a mother, the station points out.

The measure is expected to advance through the full committee, which likely will hear it in November. Republican Governor Henry McMaster has said he would sign the bill into law if the Senate passes it.

It fits within a general theme of the straight up attack on women's health that the GOP and Trump administration have been waging for the last ~3 years.
Nearly 900 women's health clinics nationwide have lost federal funds after the Trump administration implemented a "domestic gag rule" to a federal family planning program known as Title X, according to an estimate by Power to Decide, an organization that works to prevent unplanned pregnancies.

Women of color make up more than half and Latinas over a third of all Title X patients, according to the National Latina Institute for Reproductive Health.

The lack of funding could affect access to reproductive health services, including breast cancer screenings, HIV tests and birth control for over 8.7 million women living in 390 counties in the U.S.

A federal judge has blocked a controversial Alabama abortion bill that would block almost all abortions, calling it a "ban" that "contravenes clear Supreme Court precedent."

US District Judge Myron Thompson issued a preliminary injunction on Tuesday barring the Human Life Protection Act from taking effect until the court resolves the case in full. The law was slated to go into effect next month.

Thompson's decision to block the Alabama ban means that all of the state laws passed this year restricting early-stage abortions have been blocked from going into effect by the courts.

In the 17-page opinion, Thompson wrote that the state's abortion ban "violates the right of an individual to privacy, to make choices central to personal dignity and autonomy." Thompson also stated that the ban "diminishes the capacity of women to act in society, and to make reproductive decisions."

Thompson added, "It defies the United States Constitution."

It also appears to punish doctors, women and children as young as 13 with “abortion murder” if they “perform or have an abortion”. This crime is punishable by life in prison. Another new crime, “aggravated abortion murder”, is punishable by death, according to the bill.

This shit really pisses me off because they're laws people come up with who have ZERO clue about medicine, the female reproductive system, etc.

My wife had an ectopic pregnancy that nearly killed her back in 2007. There was no "reimplanting" the damn thing. She lost two liters of blood into her abdomen and would have died without emergency surgery. Thank God the doctor did everything in his power to save her tubes, which is the only reason we now have two kids. She came very close to not being able to have children at all.

The results of laws like this would be to dissuade talented people from even getting into reproductive medicine. So you lower the quality of that medicine across the board.

The Supreme Court on Monday rejected a challenge to a Kentucky law requiring doctors to describe ultrasound images and play fetal heartbeat sound to abortion seekers.

Kentucky argued the law is "simple and straightforward," calling it part of an" informed-consent process." The law, Kentucky said, "does nothing more than require that women who are considering an abortion be provided with information that is truthful, non-misleading and relevant to their decision of whether to have an abortion."

The court rejected the case without comment or noted dissent by any of the justices.

Challengers, including an abortion clinic, argued that the law forced patients to see the images even if she didn't want to, and that it violated doctors' First Amendment rights.

The law had been upheld by the 6th US Circuit Court of Appeals, but that ruling was on hold pending the Supreme Court appeal.

I'm sure this is going to be interesting:
President Trump will deliver an in-person speech on Friday at the March for Life, an annual rally held in Washington protesting the legalization of abortion.

Trump will be the first president in history to appear at the march, one of the highest-profile events of the anti-abortion movement. March for Life is in its 47th year, having taken place every year since the passage of Roe v. Wade, the Supreme Court decision that legalized abortion nationwide.

Last year, Vice President Mike Pence made a surprise appearance at the march before roughly 100,000 attendees. The president also gave a message of support for the cause to attendees through a live video.
Of note:
Jeanne Mancini, president of the organizing group, celebrated the announcement in a statement, saying Trump had been loyal to the anti-abortion movement.

"From the appointment of pro-life judges and federal workers, to cutting taxpayer funding for abortions here and abroad, to calling for an end to late-term abortions, President Trump and his administration have been consistent champions for life and their support for the March for Life has been unwavering," she said. "We are grateful for all these pro-life accomplishments and look forward to gaining more victories for life in the future.”

The Office of Civil Rights, a division of the Department of Health and Human Services, announced Friday that it is taking action against California for requiring private insurers to cover abortions. In a second rebuke to Texas GOP officials who have said a ban on nearly all abortions is essential as the state battles the novel coronavirus, a federal judge in Austin ruled Thursday that some abortions may proceed.

U.S. District Judge Lee Yeakel narrowed Texas’ prohibition to allow certain abortions to proceed while a gubernatorial emergency order barring medical procedures that are not “immediately medically necessary” still stands. The ruling will allow Texas abortion providers to proceed with medication abortions — which involve patients ingesting pills and do not consume scarce medical protective equipment — as well as procedural abortions for patients who risk meeting the state's gestational age cutoff for abortions before Gov. Greg Abbott’s emergency order is lifted.

Hundreds of abortions have already been canceled after Texas Attorney General Ken Paxton — citing the March 22 executive order from Abbott — declared last month that all abortions not critical for the life or health of the patient were prohibited. State officials said the prohibition was critical to preserve medical resources, like masks and gloves, as hospitals gear up for an onslaught of patients with COVID-19.

Abortion providers quickly sued, calling the order political opportunism and arguing before the courts that abortions rarely require hospital time and typically do not involve extensive personal protective equipment.

After a loss earlier this week at the U.S. 5th Circuit Court of Appeals — which allowed the ban in a ruling that said the government may restrict constitutional rights during an emergency — abortion providers returned to federal court in Austin with the narrower ask to allow medication and some procedural abortions.

As I saw elsewhere -- COVID-19 is too dangerous for abortions but not quite dangerous enough for voting. F the GOP and their bullshit tactics.

They used a 1905 case (Jacobson v. Massachusetts) about forcing someone to get a smallpox vaccination during a pandemic and twisted into an anti-abortion ruling in 2020. Texas included all abortions in non-essential medical procedures and the 5th circuit blessed it. Essentially, "Sorry that you died because you had a medical emergency that would have involved an abortion" but at least it wasn't covid-19. Fuck the GOP. And fuck these partisan judges.

Planned Parenthood clinics in Colorado, New Mexico, and Nevada are reporting an influx of patients from Texas, after an order from Texas Gov. Greg Abbott suspending most abortions in that state during the coronavirus pandemic.

New data provided to NPR by Planned Parenthood show a more than seven-fold increase in patients traveling from Texas to clinics in neighboring states for abortions since the order took effect in late March.

In the “deathbed confession,” McCorvey, who died in 2017, revealed to the makers of the FX documentary “AKA Jane Roe” that leaders of the evangelical religious movement paid her to switch sides on the issue. The moment reportedly occurs in the final minutes of the film, which airs Friday.

I think I read that prominent conservatives (e.g. John Voight) have been involved in making a movie about Roe, Roe, and her conversion to the pro-life cause.

This'll throw a wrench into that project.

I am opposed to abortion but those who paid her, IMO, bear the greater guilt. Not only did they know she was lying, they paid her to do so, and they deceived others through their actions and hers. I don't remember lying to advance your cause being in the Sermon on the Mount.

It is genuinely surprising to me how often people seeming decide to say "FUCK IT" and (I assume) just to totally toss aside all the morals that were instilled upon them (assume-ably) when they were taught anything about right-and-wrong.

No, she is actually MUCH worse. "they" are the 'enemy that would do anything' to promote their cause. She is fucking empty - she is false witness. She is a fraud. she is empty. She is a snake. Everything.


Not even sure what the phrase "opposed to abortion" means when you use it here, to be perfectly honest. I mean, I don't relish the idea either, but I recognize the reality of our world and I can't imagine a world where women are forced to carry a pregnancy that was unplanned, to full term. I simply, cannot.

So, while I agree that those that paid her suck, I also feel that she sucks. They all suck. The whole idea sucks and anyone that promotes it does. The right to have an abortion is the right to come to a fucking horrible decisions and to live with it without society pretending that you are a murderer. That's it. That is fucking IT.

I AM SO SICK of the 'friendly' "I am opposed to abortion, but..." shit.

I wish I could say I was consistently surprised by the morals people are willing to ignore for a buck, but I'd be lying. I (don't really) want to know what it's like to be so in love with money that little else matters.
It is genuinely surprising to me how often people seeming decide to say "FUCK IT" and (I assume) just to totally toss aside all the morals that were instilled upon them (assume-ably) when they were taught anything about right-and-wrong.
Well, when you view any developing fetus as a human life like yours or mine, then the calculus changes dramatically. What's a lie when it could serve to end an ongoing holocaust?

The Supreme Court on Thursday declined to consider a pair of disputes involving abortion restrictions in Chicago and Pennsylvania, leaving intact laws that create buffer zones outside of abortion clinics.

The first case rejected by the high court involves an ordinance in Chicago that makes it illegal for a person within a 50-feet radius from an abortion clinic to come within eight feet of another person "for the purpose of passing a leaflet or handbill, displaying a sign to, or engaging in oral protest, education or counseling."

The challenge to the Chicago law was brought by four people and two anti-abortion rights groups that engage in sidewalk counseling outside of abortion clinics and argue the ordinance violates the First Amendment.

The second dispute involves an ordinance enacted in the city of Harrisburg, Pennsylvania, that makes it unlawful for a person to "knowingly congregate, patrol, picket or demonstrate in a zone extending 20 feet from any portion of an entrance to, exit from, or driveway of a health care facility."

The Supreme Court's refusal to take up the two legal battles over the abortion restrictions follows its 5-4 ruling Monday striking down a Louisiana law that required abortion providers to have admitting privileges at nearby hospitals.

Chief Justice John Roberts joined the liberal wing of the bench in invalidating the Louisiana law, citing a 2016 Supreme Court decision striking down a nearly-identical Texas regulation.

In light of its ruling Monday, the Supreme Court tossed out lower court rulings blocking two Indiana laws from taking effect and sent the cases back to the lower courts for further consideration. One of the measures requires a woman to undergo an ultrasound at least 18 hours before an abortion and the second requires parents of minors to be given notice of a court-authorized abortion.

The Supreme Court’s recent decision in June Medical v. Russo was hailed by many liberal court watchers as a win for reproductive rights, as the court declined to overturn Roe v. Wade and formally eliminate the right to an abortion. On Friday, however, a federal appeals court ruled that June Medical significantly narrowed the constitutional right to abortion access. The 8th U.S. Circuit Court of Appeals panel swept away an injunction that had blocked Arkansas from enforcing a slew of abortion restrictions, including a requirement that patients pregnant as a result of rape notify their rapists before terminating their pregnancy. The appellate court’s decision confirms that Chief Justice John Roberts’ controlling opinion in June Medical will serve as a tool to eviscerate abortion rights. Those who briefly heralded him as a champion of reproductive freedom were too caught up in the halftime show to see the game.

Friday’s ruling in Hopkins v. Jegley greenlights four Arkansas regulations passed in 2017. The first of these laws requires clinics to report the names of abortion patients under 18 to local law enforcement. These clinics must then preserve the fetal tissue and treat it like criminal evidence. The second law forces abortion providers to spend “reasonable time and effort” acquiring a patient’s medical records for her “entire pregnancy history” before performing the abortion. The third law grants equal rights over fetal remains to both partners, with no exception in cases of rape. A patient must notify her partner before the abortion and ask which method of disposal he prefers. If both partners are minors, the patient’s parents get to decide how fetal remains are disposed of. If the patient is a minor but her partner is an adult, then he—not the patient—makes the choice. These rules effectively prohibit medication abortion, which occurs at home, where the provider cannot control the disposal of fetal remains. The fourth and final law bans the safest and most common procedure for second-trimester abortions.

It might be surprising to hear that June Medical curbed the right to abortion. After all, in that case, five justices struck down a Louisiana abortion law identical to the measure invalidated in Whole Woman’s Health. But the court actually split 4–1–4, with Roberts in the middle. The chief justice penned a separate opinion that rejected the balancing of burdens and benefits in favor of the stingier “substantial obstacle” standard. In his view, an abortion restriction can be constitutional even if it provides zero health benefits to women. In effect, the chief justice had reinstated the less robust test from 1992’s Planned Parenthood v. Casey, which had opened the door to all sorts of pretextual TRAP (targeted regulation of abortion providers) laws, that did nothing to advance maternal health, while insisting that they were helping women. Because Roberts provided the fifth vote, the 8th Circuit panel declared that his opinion is controlling on lower courts. For any judge who chooses to read it that way, going forward Whole Woman’s Health is functionally overruled, and states are free to enact any and all abortion laws, so long as they come with assertions that they protect mothers.

Poland's top court has ruled that abortions in cases of foetal defects are unconstitutional.

Poland's abortion laws were already among the strictest in Europe but the Constitutional Tribunal's ruling will mean an almost total ban.

Once the decision comes into effect, terminations will only be allowed in cases of rape or incest, or if the mother's health is at risk.

A legal challenge against the 1993 law permitting abortion in cases of severe foetal disabilities - which accounts for 98% of terminations carried out in Poland - was launched by MPs from the ruling nationalist Law and Justice party last year.

A strike is under way in Poland by women opposed to a court ruling that introduced a near-total ban on abortion in the mainly Catholic country.

Crowds have protested in several cities for the seventh-day running against the decision that outlawed terminations on the grounds of severe health defects.

An opinion poll conducted for Gazeta Wyborcza suggested that 59% of those surveyed disagreed with the change.

The powerful ruling party leader said the decision could not be reversed.

Jaroslaw Kaczynski, who is also the deputy prime minister and widely considered to be the country's real powerbroker, said the protests were an attempt to "destroy" Poland. He urged people to "defend" the nation as well as the Catholic Church.
