Certificate of Need laws
I got a survey call today about Certificate of Need laws in South Carolina. The survey question didn't really explain it, so I said I'd have to read up on it before giving an answer. So how should I feel about these? Seems most states have a version, but that in and of itself doesn't mean it's a good idea.

This is probably a lawbeef topic, but I think the intention is to control healthcare expenditures and by extension healthcare costs. Sounds like a great idea? Sure. Does it work? Ummmm, you check healthcare costs lately?

Certificate of Need law means that if someone wants to open a new healthcare facility, they must show that there's a "need" for this healthcare facility in the community. The process can be lengthy and very expensive, and in some cases, you must actually get approval not just from state regulators, but from other hospitals in the area (you are literally required to get permission from your potential competitors).
It's one of the very few - and last - things in this country that both the right and the left tend to agree on being a horrible thing for healthcare. Unfortunately, large hospital systems heavily lobby state governments against repealing these laws, and in most states so far, it worked.

Thanks! MA has a lot to say about mergers and acquisitions, but I don't think they get involved in expansions so I'm guessing we don't have this law.

I work for a hospital, and certificate of need has bit us in the ass more than once. For instance, we wanted to open a new branch on the other side of town and got denied the first time around. Had to resubmit. No telling how much money and man-hours went into this back and forth fighting to get a new building open. Every time CoN comes up, I know the stress-level across the org goes through the roof.
I'm guessing large healthcare systems lobby for it because it keeps smaller competitors from moving in on their turf.
I'm probably not the best to speak to it because I have a vested interest in my employer ruthlessly crushing everyone else.

Yeah, sounds like an idea that sounded good on paper but in practice can be abused and promotes actions opposite from what was intended by the original plan.
