Why Do Judges Hate America?

Oy.
Federal judges are jeopardizing national security by issuing rulings contradictory to President Bush's decisions on America's obligations under international treaties and agreements, Attorney General John Ashcroft said Friday.

In his first remarks since his resignation was announced Tuesday, Ashcroft forcefully denounced what he called "a profoundly disturbing trend" among some judges to interfere in the president's constitutional authority to make decisions during war.

"The danger I see here is that intrusive judicial oversight and second-guessing of presidential determinations in these critical areas can put at risk the very security of our nation in a time of war," Ashcroft said in a speech to the Federalist Society, a conservative lawyers' group.
It's quite a pervasive problem as well, because DoJ has drawn at least some rulings it hasn't liked in nearly every single case that has raised wartime detention issues, before a variety of judges at all three levels of the federal judiciary. Activists! They're everywhere! Save me, Dubya! I thought Ashcroft said he was going home because we are all safe now!

it's crazy! It's almost as if the judicial branch is trying to check or serve as a balance to the executive office in some way! Insanity!

Yeah, wasn't the court system designed to do exactly what it's doing? I know the right loves to harp about activist judges all the time, but letting the president go willy nilly with his war seems a little dangerous to me.

Are we just seeing a weak legislature rather than a powerful judiciary?

This idea that we can go to war without being legally at war is disturbing.

Now we blame/benefit the president for everything. His agenda goes to the legislature. He's reponsible for jobs, for the economy, for health care.. etc.

If Congress is going to cede it's power to the Executive branch, the judiciary has an obligation to take half.

Without addressing the merits of this article at all, why do we still pose the question "Why does X hate America?" in mock outrage when commenting on another person's remarks or actions in disparagement of the war or the current homeland security regime?

Cool people know when to stop repeating phrases that have, like, jumped the shark.

Besides, we're not done with "why does X hate America" yet. Some lunatics used it sincerely, and we're continuing to use it facetiously to make a continuing mockery of their wingnutitude.
