If he defies the subpoena, just refer him for obstruction like Bannon, but don’t bother with all the negotiations. Can the next house “un refer” or is it in Garland’s hands from there regardless of the committee being dissolved?

That'd assume that Garland would act on it. Which he won't.

Just catching up after a crazy day. A lot of people got wrapped around the axle on the subpoena aspect but for me the most chilling thing I heard was the reinforcement that the Secret Service is a disaster of an agency. They had warning about violence, weapons, and other problems directly reported to them and also relayed from the FBI. Yet they didn't do anything to coordinate with other agencies. They didn't prepare for the events they should have.

Worse in the aftermath they went into full obstruction mode. The testimony today is damning. If we had a functional government there would be in-depth investigations into Secret Service underway. The agency is broken. It is politicized. It is can't be trusted by the public much less the people it is charged to protect.

Paperwork has been filed

NEWS: The Jan. 6 select committee has formally subpoenaed Donald TRUMP, commanding him to appear for testimony on Nov. 14.

The panel wants documents from him by Nov. 4.

I assume November 14th was picked because it's close but after the mid-terms, to avoid accusations that this is just a political stunt.

Not that he's ever going to actually testify. *Maybe* if the Democrats hold the House in the mid-terms.

The polls are shifting all towards the Republican's the last couple of weeks. I'm not so confident they will even hold the senate at this point. We're a very dumb country.

Yup. And even at the highpoint in Democratic polling recently I think the Republicans never dropped below maybe 65% - 70% chance of taking the House per 538's model. And they just need to take the House to shut this down.

Ya I give no shot at holding the house. I'm just praying they somehow hold the Senate. Lose both? We're totally f'd.

What are the odds that if the republicans sweep this election, that the fringe extremists won't be the majority that make it? Or is the republican party so rotten to the core at this point that such a thing is not possible?

0? Almost every person running was hand picked by Trump based on following his bullshit. I honestly don't even know why we would bother running an election in 2024. It would be rigged from every single angle. So we have that going for us?

CNN
A sentence of four months in prison that ex-Trump adviser Steve Bannon was sentenced was shorter than the six months prosecutors were seeking, but still a noteworthy punishment and a boost to the House January 6 committee’s efforts.
...
Though the sentence was a major rebuke to Bannon’s request that he receive only probation for the offense, US District Judge Carl Nichols sided with Bannon in ruling that the former White House official would not have to serve the prison sentence until the appeal of his conviction plays out. His legal team will have 14 days to file the appeal, and if they don’t, Bannon will have to make arrangements to surrender voluntarily by November 15.
...
Nichols said that Bannon had failed to show responsibility for his conduct, a factor that ultimately led the judge to a heavier punishment. “He has expressed no remorse for his actions,” Nichols said during the proceedings, and the judge stressed that Bannon had not demonstrated that he would comply with the subpoenas.

Other factors cut in favor of a substantial penalty as well, the judge said. There were “problems,” the judge said, with Bannon’s position that Trump made an assertion of executive privilege that prevented Bannon testifying or turning over any documents.

Compassion for a defendant with Asperger's - 240 days of house arrest with a limit of 30 minutes of internet access. Prosecution had asked for 57 months. Two threads.

As a fellow "rules follower" (referred to as such by a shrink) I get house arrest in this case but smashing windows is not just following and suggests you are a danger with your "rigid thinking". At least that's the view from my seat in the peanut gallery.

Maybe 1% chance at most that that happens. Almost certainly this is just to generate a headline, either because Trump's team wants to make it look like he wants to cooperate (before breaking things off because "those radical leftists won't agree to basic protections and have made it clear that this is a witch hunt") and/or because Trump is worried that he looks like a pussy.

*Only* way this happens is if Trump's ego requires him to not punk out, and I really don't think that happens.

Right, that gets at the other thing - his lawyers want to learn as much as they can about what else the Committee knows. So they negotiate and try to fish on topics that they want to ask about.

I would say it's 0 percent chance. There is no way in hell a lawyer would let Trump on a stand, under oath. And he does listen to his lawyers. That much can be said.
